Terms and Conditions
The rules for using the HITCH website. These are separate from the terms that apply when equipment is hired.
1. About these terms
These Terms and Conditions govern your access to and use of this website. The website is operated by Hitch Hire Group Pty Ltd (ABN 64 652 329 578), referred to as HITCH, we, us or our.
By using this website, you agree to these terms. If you do not agree, please stop using the website.
2. Website use only
These terms apply only to use of this website. They are not equipment-hire terms and do not form a hire agreement.
A request, enquiry, rate-card download or message sent through this website does not reserve equipment or create a binding hire contract. A hire proceeds only after HITCH accepts the request and the parties agree to the applicable quote, hire agreement and hire terms.
3. Acceptable use
You may use this website for lawful personal or business purposes, including reviewing equipment and rates and contacting HITCH.
You must not misuse the website, interfere with its operation or security, introduce malicious code, attempt unauthorised access, submit false or misleading information, infringe another person’s rights, or use website content for an unlawful purpose.
4. Rates, specifications and other information
We take reasonable care to keep website information clear and current. Published rates are current from the effective date shown with them and exclude GST unless expressly stated otherwise. Delivery, attachments, fuel, cleaning, damage, waiting time, excess usage and other disclosed charges may also apply.
Equipment descriptions, dimensions, specifications, images, service areas and availability information are general information. You must confirm that equipment is suitable for your job, access and site conditions before hire.
We may correct errors and update website information or future rates. Any change does not alter an accepted written quote or hire agreement unless that agreement permits it.
5. Enquiries and communications
You are responsible for making sure information you submit is accurate and that you are authorised to provide it. We may contact you about your enquiry using the details you provide.
If you separately opt in to marketing or opening updates, we may send information about HITCH, rates and events. Each commercial electronic message will identify HITCH and provide a way to unsubscribe. You may unsubscribe at any time, and we will process the request as required by the Spam Act 2003 (Cth).
6. Privacy
Our Privacy Notice explains the information we collect through this website and how we handle, store and disclose it. By submitting information, you acknowledge that notice.
7. Intellectual property
Unless stated otherwise, HITCH or its licensors own the website and its content, including text, photographs, graphics, logos, branding and layout.
You may view, print or save reasonable extracts for your own genuine equipment-hire enquiry. You must not reproduce, republish, modify, distribute, sell or commercially exploit website content without our prior written consent, except where the law permits.
8. Third-party websites
Links to maps, social media, manufacturers or other third-party websites are provided for convenience. HITCH does not control those websites and is not responsible for their availability, content, accuracy, security or privacy practices. Accessing them is subject to their own terms and policies.
9. Website availability
We aim to keep the website available and secure, but we do not promise uninterrupted or error-free access. We may suspend, withdraw or change the website where reasonably required for maintenance, security, operational or legal reasons.
10. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. These terms must be read subject to those rights.
11. Liability for website use
To the maximum extent permitted by law, HITCH is not liable for indirect or consequential loss arising only from your use of, or inability to use, this website.
This limitation does not apply to liability caused by our fraud, wilful misconduct or negligence, or to any liability that cannot lawfully be excluded or limited. Liability relating to an equipment hire is governed by the applicable hire agreement and the law.
12. Changes to these terms
We may update these terms when our website, practices or legal obligations change. Updated terms take effect when published here. We will update the effective date and take reasonable steps to identify material changes. Your continued use of the website after an update means the revised terms apply to that use.
13. Governing law
These terms are governed by the laws of Victoria, Australia. You and HITCH submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.
14. General
If any part of these terms is invalid or unenforceable, it is to be read down to the extent necessary or severed, and the remaining terms continue to apply. A delay in exercising a right does not waive that right.
